Agreement to Terms

These Terms of Service ("Terms") govern your use of the Water Cooler Wisdom LLC website and any services you purchase or sign up for through it, including website design and build services, hosting, AI assistant services, and coaching ("Services"). By using this site or engaging our Services, you agree to these Terms.

Our Services

We offer website design and development, ongoing website hosting and maintenance, AI-powered assistant tools, and business coaching services, as described on the relevant pages of this site. Specific offers (including pricing, guarantees, and promotional terms) are described on the page where that offer is presented, and those page-specific terms apply in addition to these Terms.

Payment Terms

Some Services require a one-time payment, and some involve ongoing monthly payments (such as hosting). Payment terms specific to an offer are described on that offer's page. Payments are processed by a third-party payment processor; we do not store your full payment card information.

Ownership of Your Website

Unless otherwise agreed in writing, you own the content and design of the website we build for you once it has been delivered to you. If you are on an ongoing hosting plan with us, we host and maintain the site on your behalf for as long as that plan is active. You may request an exportable copy of your website files at any time, including at the time of cancellation, by contacting us.

Cancellation

You may cancel an ongoing hosting or service plan at any time by contacting us. Cancellation takes effect at the end of your current billing cycle. We do not provide prorated refunds for partial billing periods, except where a specific offer's guarantee or refund policy says otherwise.

Our Right to Decline Requests and End Service

We may decline or refuse any website request at any time. If you are on a recurring service or subscription (such as hosting or maintenance), we may also cancel your subscription and stop working with you at any time.

Your Responsibilities

You are responsible for providing accurate information, responding to us in a timely manner during the build process, and telling us about any specific requirements your website or service needs to meet — including accessibility standards (such as ADA or WCAG), industry-specific regulations, or other compliance requirements. We build to general best practices, but we are not responsible for requirements you do not communicate to us.

You are also responsible for ensuring that any content, images, logos, or text you provide to us for use on your website does not infringe on the rights of any third party. You agree to indemnify and hold us harmless from any claim arising from content you provide.

No Warranty

Our Services are provided "as is" and "as available." Except for guarantees explicitly stated on a specific offer's page, we do not make any warranties, express or implied, about the Services, including any warranty that the Services will be uninterrupted, error-free, or fit for a particular purpose.

Limitation of Liability

To the fullest extent permitted by law, Water Cooler Wisdom LLC will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the three months before the claim arose.
